SHARGE Terms of Service

These Terms of Service ("Terms") govern your use of the SHARGE mobile app and electric vehicle (EV) charging services provided by Sharge Management Company Limited ("SHARGE", "we", "us", or "our"). By accessing or using any part of the Services, you agree to be bound by these Terms. If you do not agree, please do not use the Services.


0. Definitions

Services” means the SHARGE mobile app, EV charging network, and related features.
 “Account” means your registered SHARGE account.
 “Charging Session” means a single use of a SHARGE-enabled charger.
 “Fees” include energy tariffs, idle/overstay, parking, reservation and other applicable charges.
 “Host” means the site or property owner/operator of a charger.
 “RFID” means a physical identifier issued by SHARGE.


1. Account Registration

To use SHARGE, you must create an account and provide accurate, up-to-date information. Your use of the Services is also subject to SHARGE’s Privacy Policy.


1A. Eligibility & Account Security

You represent that you are at least the age of legal capacity under Thai law and have authority to enter into these Terms. You are responsible for all activity under your account, RFID card, or credentials (including sessions started via the app, card, or other authenticators). You must promptly notify SHARGE of any suspected unauthorized use.


2. Phone Number Verification

Verification of your mobile number by One-Time Password (OTP) is required to access SHARGE. Your phone number is used for account security, customer service, alerts, and (if consented) marketing. Your telephone number will be processed in accordance with Thailand’s PDPA. Marketing consent can be withdrawn at any time via in-app settings or by contacting support.


3. Use of Services

You agree to use SHARGE Services in compliance with applicable laws, local rules, and SHARGE’s operational policies.


3A. Prohibited Conduct at Charging Sites

You shall not:
 (a) damage, tamper with, or improperly use any charger, cable, or hardware;
 (b) block access to connectors or occupy a bay without actively charging where local rules prohibit it;
 (c) use unsafe adapters or non-compliant accessories;
 (d) violate posted site rules or property owner instructions;
 (e) engage in unsafe or disruptive behavior.


3B. Roaming & Third-Party Networks

You may access chargers operated by third parties via roaming arrangements. Pricing, availability, and support boundaries may differ. Session data may be shared with the roaming partner to deliver the Services. SHARGE is not responsible for third-party site rules or facilities beyond what Thai law requires. For roaming sessions, SHARGE acts as a conduit for access and billing; site operations and facilities remain the responsibility of the third-party operator under applicable law.


3C. Reservations & No-Show

Where reservation is offered, a no-show or late arrival beyond the grace period shown in-app may incur a reservation or cancellation fee. SHARGE may release the bay and/or cancel the reservation after the grace period.


4. Fees & Billing

4.1 Pricing is displayed in-app and/or at the station and may vary by location or time.
 4.2 Payment Timing: Payment will be processed via your registered method within 24 hours of session completion.
 4.3 Failed Payments: If a payment fails, SHARGE may reattempt charges, suspend access, or take legal recovery steps. Collection costs permitted under Thai law may apply.
 4.4 Fraud and Misuse: SHARGE may reverse benefits and charge back fees if fraud or exploitation is detected.
 4.5 Refunds: Refunds are at SHARGE’s discretion under our Refund Policy and applicable law.
 4.6 Billing Disputes: Notify SHARGE in writing within 30 days of the charge, or it is deemed accepted.
 4.7 Idle/Overstay/Reservation Fees: Idle, overstay, parking, or reservation fees may apply as shown in-app or at the site. These form part of “Fees.”
 4.8 Promotions, Credits, and Value Packs: If offered, these are non-transferable, non-refundable, and subject to app-specific terms.
 4.9 Taxes & Currency: Prices are in THB and include VAT unless otherwise stated. FX conversion, if any, is handled by your issuer.
 4.10 Metering & Session Data: Billing is based on meter readings and SHARGE logs. In case of discrepancy, SHARGE and/or Host records prevail under Thai law.


5. Marketing & Communications

SHARGE may send you service and promotional messages. You can opt out of marketing at any time.


5A. Property Rules; Towing & Enforcement

You must comply with the posted site rules and instructions from property owners. Hosts may enforce parking regulations, including towing, under local laws. SHARGE is not liable for third-party enforcement actions.


6. Intellectual Property

All content, technology, software, trademarks, and systems are the property of SHARGE or its licensors.


7. Service Suspension

We may suspend or terminate accounts for violations of these Terms, misuse, safety risks, fraud, or legal non-compliance.


7A. Complaints & Dispute Resolution

You can submit complaints via the Contact section. SHARGE will acknowledge and respond within a reasonable time. This does not limit your rights to bring legal claims under Section 10.


8. Limitation of Liability

SHARGE is not liable for indirect, incidental, or consequential damages. Our liability is limited to the amount you paid in the last 12 months.


8A. No Warranties

THE SERVICES, APP, AND HARDWARE ARE PROVIDED “AS IS.” TO THE MAXIMUM EXTENT ALLOWED BY THAI LAW, SHARGE DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR PURPOSE, AND NON-INFRINGEMENT. SHARGE DOES NOT GUARANTEE UNINTERRUPTED OR ERROR-FREE SERVICE.


9. Force Majeure

SHARGE is not liable for delay or failure caused by circumstances beyond our control, including natural disasters, cyberattacks, power failures, or government actions.


10. Governing Law

These Terms are governed by the laws of Thailand. Any disputes shall be subject to the exclusive jurisdiction of Thai courts.


10A. Indemnification

You agree to indemnify and hold harmless SHARGE, its affiliates, officers, and employees from claims, losses, or costs arising from your misuse of the Services or violation of these Terms, to the extent permitted by Thai law.


11. Notices

SHARGE may notify you via in-app messages, email, SMS, or postal mail using your latest contact information. You agree to accept legally binding communications electronically.


12. Termination & Survival

SHARGE may suspend or terminate your account or access to Services for violations, fraud, legal issues, or misuse. You may terminate at any time via app or by contacting support.

The following sections survive termination: 4, 5, 6, 7, 8, 8A, 9, 10, 10A, 11, 12, 14.

14. Changes to These Terms

We may update these Terms from time to time. Updates take effect upon posting unless otherwise stated; continued use constitutes acceptance.
